Designated Delivery Storage Facilities

Introduction

In order to regulate delivery behaviors and ensure the normal operations of delivery, physical delivery of the futures contract of the Shanghai International Energy Exchange (hereinafter referred to as “the Exchange”) shall be performed at the delivery storage facilities designated by the Exchange. The Designated Delivery Storage Facilities include the warehouses and the factories. Warehouse refers to a facility of a licensed commodity storage enterprise which has been approved and designated by the Exchange for the physical delivery of a commodity futures. Factory refers to a facility of a producer which has been approved and designated by the Exchange for the physical delivery of a commodity futures. The Exchange shall supervise the futures business of designated delivery storage facilities in accordance with the relevant rules and regulations.

Relevant Procedures

Business of designated delivery storage facilities shall include new establishment and change of warehouses and factories, which is contained mainly in the Delivery Rules of the Shanghai International Energy Exchange.

Procedures for New Establishment of Designated Delivery Storage Facilities

(1) A delivery storage facility operator submits the application and relevant materials for the designated delivery storage facility to the Exchange;
(2) The Exchange conducts a preliminary examination of the delivery storage facility operator and the proposed delivery storage facility;
(3) The Exchange conducts an on-site investigation and assessment for the proposed delivery storage facility after preliminary examination; 
(4) Based on the results of the on-site investigation and assessment, and the provisions of the laws and regulations, the Exchange selects the best applicants and enters into an agreement of Designated Delivery Storage Facility with the candidate; 
(5) The delivery storage facility completes relevant formalities prescribed by the Exchanges; 
(6) The Exchange publicizes to the market and completes the procedures.

Procedures for Change of Designated Delivery Storage Facilities

(1) The Designated Delivery Storage Facility applies to the Exchange for changes in name, capacity, storage address, cargo location, etc.; 
(2) The Exchange conducts a preliminary examination of relevant application for changes; 
(3) The Exchange conducts an on-site investigation and assessment for the proposed delivery storage facilities after preliminary examination; 
(4) The Exchange reviews the application for changes in capacity, storage address, cargo location, etc. of the Designated Delivery Storage Facility if it passes the on-site investigation and assessment. 
(5) After the Designated Delivery Storage Facility completes the data change and maintenance in the warrant system, the Exchange will publicize to the market.

Procedures for Inspection of Designated Delivery Storage Facilities

(1) The Exchange collects such information as client complaints about the Designated Delivery Storage Facility; 
(2) The Designated Delivery Storage Facility performs annual comprehensive examination, prepare self- examination reports and submit an annual summary to the Exchange; 
(3) The Exchange implements random checks and annual examinations; 
(4) The Exchange conducts assessment and evaluation based on random checks and annual examinations; 
(5) The Exchange issues the notice for rectification to the delivery storage facilities that fail the examinations; 
(6) The Exchange renews the agreement with the delivery storage facilities that pass the examinations and review; 
(7) The Exchange disqualifies the Designated Delivery Storage Facilities that fail the review after rectification.
